1. Definitions
You, the Customer
a person or company buying Products from us.Consumer a private person buying Products for private use. If you are a Consumer, please find your specific rights and exceptions in Section 10.
EfficientPC (us, the supplier) the Product vendor as identified on your invoice and, where relevant, Service Provider.
Software computer operating systems, middle ware or applications.
Product computers built to specification, components and peripherals purchased from us.
2. Quotations/Orders/Contract
Specifications of computers consist of the hardware and software specified by the customer, no additional software or hardware should be presumed included unless specifically ordered or otherwise stated on the order page, this includes floppy drives, CD/DVD burning software. EfficientPC reserves the right to change Products (incl. 3rd Party Products) at any time but we guarantee equivalent or superior functionality and performance.3. Price & Payment Terms
Prices quoted by us are normally inclusive of value added tax or any similar taxes, levies or duties. The costs of carriage, delivery, packaging and insurance are excluded from the product price.Full payment must be received prior to despatch, we will begin processing your order once cleared funds have been received.
4. Delivery/Title/Risk
The delivery period stated is approximate. Computer orders are normally dispatched within 10 working days. Components normally dispatched within 2 working days.We are entitled to deliver orders in installments in the event that certain components are out of stock.
The place of delivery is stated in the Order Confirmation.
Risk of the loss of the goods passes to you on delivery.
Standard delivery rate applies for orders within the UK, excluding Northern Ireland and UK Isles which attracts a £15 surcharge.
When signing for delivered goods you must be satisfied that the goods have arrived in undamaged condition, if this is impractical the delivery note must be signed for as "unchecked", otherwise transit insurance would be void and the customer would be responsible for repair costs. When you receive Product you must inspect it for any defects or non-conformity within 7 days.
After this period the goods are conclusively deemed as accepted. If EfficientPC agrees to the return of Product at its choosing an RMA number must be obtained, the product must be in its original condition with packaging, a return note and proof of purchase; the return costs may also be payable by you.
5. Software
Software not owned by us is supplied subject to license and warranty of the Software licensor. We enclose the Software license that you require with the Product where necessary; you must comply with that license.6. Warranty
We warrant that goods will at the time of delivery be free from defects in workmanship and materials and correspond in all material respects with the relevant product specification. We guarantee that the Goods (excl. peripherals) will be free from defects for 12 months from delivery. If any goods do not conform to this warranty then we will at our option either remedy the defect in question, replace the defective Goods or refund the price of the defective Goods. 12 months of warranty cover parts and labor.The warranty period commences on the next day after delivery or collection.
The provision of the service under this warranty will be on the base unit only and does not include monitors or other peripherals, which are covered by separate manufacturers warranty agreements.
In normal circumstances we provide return-to-base warranty. In the event that a computer must be returned to EfficientPC the sender is responsible for organizing the dispatch and packaging of the computer. EfficienPC would cover the courier costs when returning an item in the event that it is DOA (Dead on arrival) only. Otherwise, we can arrange for collection and re-delivery for £36.
Any repairs or parts supplied or other work carried out which are found to be outside the terms of this warranty will be charged to the purchaser, and will be payable at the point of service.
If no fault is found or the fault is outside the scope of the warranty than a charge of £36 transportation costs will apply.
The purchaser must ensure the environmental and power supply conditions are suitable for the equipment, and that the equipment is cared for and maintained in accordance with the manufacturers recommendations and instructions.
The user is entitled to upgrade the following components without affecting the warranty: Graphics card, memory, hard disk drive, optical drives, PCI cards. It is the purchaser's responsibility to ensure that adequate back-ups of all applications, operating systems and data are maintained. In the event of fault emanating from a manufacture or design fault, it may be necessary for the machine to be returned to the manufacturer for fault diagnoses, repair and test.
Monitors are governed by separate manufacturer's warranty.
Exclusions
Software and Operating Systems. Breakdowns or failures arising from any external influences such as misuse, neglect, excessive wear to the equipment and other external influences such as, but not limited to, poor environmental conditions, electrical power surges, power failure, the use of incompatible or uncertified accessories or media (pirate copies) and the effect of computer viruses.The replacement of any parts classed as consumables, such as floppy disks, tapes, magnetic media of any type and batteries.
Any consequential loss or liability of any kind to the purchaser caused by any decisions or actions made during or after the period when the services were delivered.
7. Force Majeure
EfficientPC is not liable for delays in performance (incl. delivery or Service) caused by circumstances beyond its reasonable control; examples include strikes, terrorist acts, war, supplier / transport / production problems, exchange fluctuations, governmental or regulatory action and natural disasters. If this lasts more than 2 months, this Agreement may be terminated by either party without compensation.8. Data Protection
Your data will be held and/or transferred in strict accordance with the applicable data protection laws. Your details will not be transferred to third-parties.9. Returns
Turnaround varies from 3-10 working days for returned PCs. We will contact you once the PC is tested and will inform you whether or not you are entitled to a full refund.If the PC is found to be faulty within the first 30 days of receipt, then we will gladly be able to offer a full refund. However, if the PC is found not to be faulty or is outside the scope of our warranty for what ever reason, then you may be charged for collection and re-delivery or a cancellation charge may apply. For this reason, please make sure that the faults you have diagnosed are not due to incompatibility or software issues.
All original CDs and manuals supplied must be returned as you may not be entitled to a full refund if these are not returned with the PC.
If a problem with the PC is reported within 30 days of receipt we will arrange collection and re-delivery free of charge. A collection and re-delivery charge will apply if no fault was found by our technicians or if the fault is software-related.
A collection and re-delivery applies for PCs within the warranty period returned after 30 days of receipt. Any PCs after the first 30 days of receipt are excluded from refunds.
We can offer a refund to non-faulty PCs as long as they are returned to us within the first 7 days of receipt. This is known as our cooling off period and there is a 15% cancellation fee (excluding delivery costs) for PCs as they are custom built to order. Any non-faulty PCs sent back to us after the "cooling off" period are excluded from the right to cancel.
Any software that was purchased with the PC and has been activated or registered is excluded from a refund as we can no longer use them.
We cannot offer a full refund for computer orders as every system is custom made to customer's requirements using specially ordered components and the system cannot be resold. It is therefore excluded from the right to cancel unless the PC is found to be faulty in the allocated time period.
Please note that returned PCs must be securely packaged in their original box. We will not be responsible for any damage caused by inappropriate packaging and cannot offer a refund if the original packaging is not sent back or the PC arrives damaged.
